Service Terms and Conditions for Waste Collection Croydon

These Terms and Conditions set out the basis on which we provide waste collection services in Croydon and surrounding areas. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order for waste removal or related services.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context requires otherwise, the following expressions have the following meanings:

1.1 Service means any waste collection, removal, loading, transportation, disposal or related service that we agree to provide.

1.2 Customer means the individual, business, organisation or other entity requesting the Service.

1.3 Waste means any items, materials, rubbish, junk or refuse presented by the Customer for collection, excluding any prohibited or hazardous items not agreed in advance.

1.4 Contract means the agreement between us and the Customer for the supply of the Service, incorporating these Terms and Conditions and any written confirmation of booking.

1.5 Premises means the address or location where the Service is to be performed.

2. Scope of Service

2.1 We provide scheduled and one-off waste collection services for domestic and commercial customers within Croydon and nearby service areas, subject to operational capacity and access.

2.2 The exact scope of the Service, including the type and approximate volume of waste, the date and time window of collection, and any specific access arrangements, will be agreed at the time of booking and confirmed in writing or by electronic communication where possible.

2.3 Unless expressly agreed in writing, our Service is limited to the collection, loading and removal of waste from the Premises to an authorised facility for treatment, recycling or disposal in accordance with applicable law.

3. Booking Process

3.1 Bookings may be made by telephone, email or any other booking method we make available from time to time.

3.2 At the time of booking, the Customer must provide accurate information, including but not limited to:

a. Full contact details.

b. Exact Premises address and any access restrictions.

c. Description, type and estimated volume or weight of the waste.

d. Preferred collection date and time window.

3.3 The Customer is responsible for ensuring that the information provided is complete and accurate. We are entitled to rely on the information supplied when providing a quotation and planning the Service.

3.4 Any quotation given prior to inspection of the waste is an estimate only and is subject to revision if, on arrival, the actual volume, weight, type or condition of the waste differs materially from that described by the Customer.

3.5 A booking is only confirmed when we have accepted the Customer’s request and, where required, the Customer has paid any deposit or prepayment specified at the time of booking.

4. Access and Customer Obligations

4.1 The Customer must ensure that our operatives have safe and reasonable access to the Premises at the agreed time. This includes providing clear instructions for entry, parking and any access codes or contact details needed.

4.2 The Customer must ensure that the waste to be collected is clearly identifiable, separated where necessary, and located in a safe and accessible area.

4.3 The Customer warrants that they are either the owner of the waste or have full authority from the owner to arrange its removal.

4.4 The Customer must not present for removal any items classified as hazardous or requiring specialist handling, such as asbestos, certain chemicals, clinical waste, gas bottles, or any other material we have expressly excluded, unless we have agreed in writing to provide a suitable specialist service.

4.5 If we are unable to carry out the Service due to lack of access, unsafe conditions, or the presence of prohibited materials, we may at our discretion charge a reasonable call-out or waiting fee to cover our costs.

5. Pricing and Payment Terms

5.1 Prices are generally based on factors including the volume and weight of waste, type of material, access conditions, labour required and disposal costs. Pricing details will be communicated to the Customer before the Service is confirmed, subject to clause 3.4.

5.2 Unless otherwise agreed in writing, payment is due on or before completion of the Service. We may require full or partial prepayment at the time of booking, particularly for larger collections or commercial services.

5.3 Accepted payment methods will be communicated at the time of booking and may include cash, card payment, bank transfer or other methods we make available.

5.4 For commercial Customers with agreed credit terms, invoices are payable by the due date stated on the invoice. We reserve the right to charge interest on overdue sums at the statutory rate until payment is received in full.

5.5 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any taxes that apply will be added to the total charge at the prevailing rate.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us as soon as possible and no later than the cut-off time communicated at the time of booking.

6.2 If the Customer cancels a booking within a reasonable time before the scheduled collection, any prepayment may be refunded or credited, subject to any administrative charge we reasonably apply.

6.3 If the Customer cancels or materially changes a booking at short notice, or if we attend the Premises and are unable to complete the Service due to the Customer’s act or omission, we may charge a cancellation or call-out fee up to the amount of the original quoted price.

6.4 We reserve the right to cancel or reschedule the Service due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, road closures, staff illness or legal restrictions. In such cases, we will notify the Customer as soon as reasonably practicable and offer an alternative date or a refund of any prepayments for services not performed.

7. Waste Types and Regulatory Compliance

7.1 We operate in compliance with applicable UK waste management legislation and regulations. All waste collected will be transported only to authorised and licensed facilities for treatment, recovery, recycling or disposal.

7.2 We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, illegal, improperly contained, contaminated, or otherwise unsuitable for our standard Service.

7.3 The Customer is responsible for accurately describing the nature of the waste before the Service takes place. If we discover prohibited or misdescribed items during collection, we may:

a. Refuse to remove such items.

b. Remove them subject to an additional charge and, if necessary, specialist arrangements.

c. Suspend the Service and charge for costs already incurred.

7.4 Where required, and where the Customer provides correct and complete information, we will issue appropriate documentation for the transfer of waste, including waste transfer notes or consignment notes, in line with applicable legislation.

8. Customer Representations and Warranties

8.1 The Customer represents and warrants that:

a. They have the legal right and authority to request the removal of the waste.

b. The waste does not contain any items that are explosive, highly flammable, radioactive, biohazardous or otherwise unlawful to handle or transport in the manner requested.

c. The Premises are safe for our operatives to access and work within, and any known risks or hazards have been disclosed in advance.

8.2 The Customer will indemnify us against any claims, losses, damages, costs or expenses arising from the Customer’s breach of these warranties or of any applicable waste or environmental laws.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Service. However, we shall not be liable for any loss or damage arising from:

a. The Customer’s failure to provide accurate information.

b. Lack of access or unsafe conditions at the Premises.

c. The presence of prohibited or incorrectly described materials.

9.2 While our operatives will take reasonable care when moving waste through the Premises, the Customer must ensure that fragile items, valuables, and personal possessions are removed from areas where we will be working. We will not be liable for minor cosmetic damage or pre-existing defects.

9.3 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be excluded or limited by law.

9.4 Subject to clause 9.3, our total liability arising under or in connection with any Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable for the Service giving rise to the claim.

10. Timing and Service Performance

10.1 We will make reasonable efforts to carry out the Service on the agreed date and within the agreed time window. However, all times are estimates and are not guaranteed unless expressly stated as such in writing.

10.2 We are not liable for any indirect or consequential losses resulting from delays that are outside our reasonable control, including traffic conditions, accidents, vehicle breakdowns or adverse weather.

10.3 If we are running significantly behind schedule, we will endeavour to notify the Customer using the contact details provided at the time of booking.

11. Ownership and Title to Waste

11.1 Once the waste has been loaded onto our vehicle and the Customer has confirmed that the collection is complete, ownership and responsibility for that waste transfers to us, subject to any applicable law.

11.2 We reserve the right to sort, segregate, recycle, recover, treat or dispose of the waste by any lawful method, at our discretion and in line with regulatory requirements.

12. Complaints and Disputes

12.1 If the Customer has any concerns about the Service, they should contact us promptly with full details so that we have an opportunity to investigate and, where appropriate, remedy the issue.

12.2 We aim to handle complaints fairly and efficiently. Where a dispute cannot be resolved informally, the parties may consider using alternative dispute resolution procedures before commencing legal proceedings.

13. Data Protection and Privacy

13.1 We will handle personal data provided by the Customer in accordance with applicable data protection laws.

13.2 We will use the Customer’s contact details and related information only as necessary to process bookings, deliver the Service, manage accounts and comply with legal obligations.

14. Variations and Updates to Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect for new bookings from the date on which the updated terms are made available.

14.2 The Terms and Conditions applicable to a particular Service are those in force at the time the booking is confirmed, unless we have agreed in writing to a variation with the Customer.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any Contract arising under them shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the Service, including any non-contractual disputes or claims.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 The Contract is between us and the Customer. No other person shall have any rights to enforce any of its terms. The Customer may not transfer or assign their rights or obligations without our prior written consent.

16.4 These Terms and Conditions, together with any written confirmation of booking and any agreed variations, constitute the entire agreement between the parties in relation to the Service and supersede any previous communications or understandings.
